The question

Is it obligatory to return the price of gold jewelry to the former wife, which she took before the divorce with her consent and then denied? And does the deferred dowry of 2000 dirhams become void by her waiving her divorce rights in exchange for 4000 dirhams? And is it true that a woman who seeks divorce without a reason will not enter Paradise?

The answer

The authentic of the Prophet forbids a woman from seeking divorce from her husband without a legitimate reason, and warns that she who does so will be deprived of the scent of Paradise. If the wife relinquishes her rights resulting from divorce in exchange for a sum of money, then she has no right to demand any of them. As for the deferred dowry (mu'akhkhar sadaq), it is a debt owed by the husband that divorce does not waive unless the wife waives it, and he must pay it to her when it becomes due. Regarding gifted jewelry, if the wife agrees to waive it willingly, then she has no right to demand it, and this requires proof. In case of dispute, it is advisable to resort to the court.
