Scholars have differed regarding the marriage of a man who committed adultery with a woman and she became pregnant by him: The Malikis, Hanbalis, and Abu Yusuf from the Hanafis permitted it. However, if someone other than the adulterer marries her, it is not permissible for him to have intercourse with her until she gives birth, according to the Hanafis. The Shafi'is, on the other hand, held that intercourse is permissible upon marriage. If the adulterer marries her, he may have intercourse with her, but the first child will not be attributed to him.
