It is obligatory for anyone intending Hajj or Umrah to enter into a state of ihram from the miqat they pass through. Whoever passes it without ihram has committed a forbidden act. They must return to it to enter ihram. If they do not return, a sacrifice (dam) becomes obligatory upon them, whether with or without an excuse, knowing or ignorant, intentional or forgetful. The sin is dropped with an excuse. There is no difference between returning to the same miqat or another miqat that is equal in distance.
