Is it permissible to appropriate a portion of land dedicated as a cemetery, in which a number of Muslims have been buried, in order to build a mosque upon it, given the presence of a large mosque 150 meters away, and given that the endower has passed away?

It is not permissible to build a mosque on land endowed for a cemetery, in which burials have already taken place, because Islamic law prohibits building mosques over graves, and because it violates the condition of the endower. Although scholars differ on the permissibility of converting an endowment to another charitable cause if it is more deserving, this case does not fall under that ruling due to the presence of a nearby mosque. It is more appropriate to leave the land for burying the dead and to build another mosque in a place where its people need it.
