However, if it was possible to avoid the situation, but you failed to do so due to oversight, drowsiness, a vehicle malfunction, or excessive speed, then you are liable, even if the traffic authorities decide otherwise. In this case, the blood money for the life lost falls upon your 'aqila (male kin), and expiation is incumbent upon you. If you are permanently unable to fast, some scholars are of the view that expiation is waived due to the impossibility of emancipation and the absence of any other prescribed alternative besides fasting. Others are of the view that feeding sixty poor people is required, by analogy with the expiation for violating the sanctity of fasting.
