The answer

A woman's claim that her ex-husband did not give her the gold is a forbidden lie, and even if the court rules in her favor, it is an unlawful appropriation of wealth. Similarly, a husband's claim and oath that he handed over the belongings—if they belong to the wife—is a forbidden lie, made more heinous by being confirmed with an oath. Abdullah ibn Mas'ud (may Allah be pleased with him) narrated that the Prophet (peace be upon him) said: "Whoever swears an oath by which he wrongfully acquires property, and he is a transgressor in that oath, he will meet Allah while He is angry with him." The verse (Indeed, those who exchange the covenant of Allah and their oaths for a small price) was revealed to confirm this. Um Salamah (may Allah be pleased with her) narrated that the Prophet (peace be upon him) said: "Indeed, I am only a human being, and you bring your disputes to me. Perhaps one of you may be more eloquent in presenting his case than another, so I rule in his favor based on what I hear. So, whoever I rule in his favor regarding something that belongs to his brother, let him not take it, for I am only cutting off for him a piece of hellfire." The woman must repent and drop the claim for gold and jewelry from the lawsuit. As for the belongings and furniture, if they are her property or part of her dowry, she has the right to claim them. It is advisable to mediate to reach an agreement to drop the lawsuit and receive the belongings. If there is a dispute over ownership, the advice is to seek arbitration from trustworthy scholars.
