The question

What is the ruling on the interference of the husband's family and their slandering of the wife with whom the marriage contract has been concluded (ma'qoud 'alayha) for the purpose of divorcing her, and what is the difference between the wife with whom the marriage contract has been concluded (ma'qoud 'alayha) and the wife with whom consummation has occurred (madkhoul biha) regarding "living together with kindness" (al-mu'ashara bil-ma'rouf), and is the husband obligated to obey his parents in divorcing his wife without a legitimate Shar'i reason?

The answer

The Sharia-compliant marriage contract establishes all marital rights and obligations. However, maintenance (nafaqah) and clothing (kiswah) are not obligatory for the wife until she enables her husband to consummate the marriage. She has the right to refuse cohabitation or travel with him until he pays her the prompt dower (mahr mu'ajjal). Upon the conclusion of the contract, both spouses must treat each other with kindness, as Allah Almighty said: "And due to them is [justice] like that which is due from them, in a reasonable manner." The intervention of family to resolve a marital bond is permissible if it serves a legitimate purpose, such as offering advice. However, it is not permissible if it is merely due to a whim for another woman. It is advisable not to press the husband for divorce, as he might change his mind. If divorce occurs, we ask Allah to grant her something better than it, in accordance with His saying: "But perhaps you hate a thing and it is good for you; and perhaps you love a thing and it is bad for you. And Allah knows, while you know not."
