Marriage without a wali (guardian) is invalid according to the majority of scholars. The person most entitled to give a woman in marriage is her father. If the father lacks the capacity for wilaya (guardianship), or if he is preventing his daughter from marrying (aadhil), then the guardianship transfers to the next closest guardian in the aforementioned order. If she has no righteous wali, then the Muslim judge marries her with her permission, based on the Prophet's (peace and blessings be upon him) saying: "The ruler is the wali of one who has no wali."

If a suitable match proposes to you, neither your mother nor anyone else has the right to prevent you from marrying. The one who marries you off is your father. If he refuses to marry you to a suitable match, then he is preventing you (aadhil). You have the right to refer the matter to the judge to marry you off or to order your wali to marry you.
