If a wife refuses without a legitimate excuse, she is considered disobedient (nashiz) and forfeits her right to maintenance. The husband then has the right to discipline her according to Islamic law. If the husband is unable to rectify her behavior, he may marry another woman or divorce her and marry someone else. Marriage may become obligatory for him if he fears falling into temptation.

Mild intellectual disability that does not reach the level of insanity is not among the defects that warrant annulment of the marriage. It is preferable to disclose it before marriage to prevent disputes.
