The fatwa is that if a man divorces his wife three times while she is in her 'iddah (waiting period) from a previous divorce, then she becomes irrevocably separated from him by a major divorce (baynunah kubra). She is not lawful for him until she marries another husband – a marriage of desire – who then divorces her or dies, and her 'iddah from him ends. However, according to the opinion of Shaykh al-Islam Ibn Taymiyyah, if this divorce was the first, then she can be taken back (revoked) before the end of her 'iddah. It is preferable to present these matters to the Sharia court or to trustworthy scholars.
