The majority of scholars hold that a non-Muslim woman has no right to custody. If the child's mother is not Muslim, custody transfers to the next eligible person among those entitled to it. If the father is in a different country from the mother, the majority of scholars rule that custody belongs to him, even if the mother is qualified for custody. Anyone afflicted with such a situation must strive to bring their child to them, teach them Islam, and raise them well.
