The majority of jurists agree that infertility is not a defect that justifies the option of فسخ (annulment) of the marriage contract. Rather, it is recommended for an infertile person to inform the other party before the contract. This is the view held by the majority of jurists, who limit marriage defects to specific ones, unlike Ibn Taymiyyah and Ibn al-Qayyim, who adopted a broader view to include as a defect anything customarily considered repulsive, such as infertility. It is preferable for a man not to conceal his condition from the fiancée, unless he is reasonably sure of her acceptance. Otherwise, it is preferable for him to seek a woman who is content with his situation.
