Is it permissible to take back one's wife after divorcing her for the second time, with the intention of divorcing her again, knowing that the first divorce was merely to frighten her?

Divorce during menstruation is forbidden by scholarly consensus (ijma'), but it is considered valid by the majority of scholars, including Malik, Al-Shafi'i, and Ahmad according to the well-known opinion, and this is the fatwa we issue. However, Ibn Taymiyyah and Ibn Al-Qayyim hold the view that it does not occur. You are permitted to take your wife back as long as she is within her waiting period ('iddah), and she must remain in the marital home until the 'iddah concludes. She is not allowed to be expelled, unless she commits a clear act of indecency. It is preferable to refer divorce cases to the Sharia court.
