If the driver adheres to traffic laws and does not excessively avoid collision, and the pedestrian errs by crossing from an undesignated area, then neither blood money (diyya) nor expiation () is obligatory upon the driver, because there is no guarantee for that which cannot be avoided. However, if the driver fails to observe any of the aforementioned, then both blood money and expiation are incumbent upon him. If the driver is liable due to his negligence, he must then seek out the injured party to ascertain the true nature of their injury; if the injured party dies, blood money and expiation become obligatory. If they are wounded or suffer a fracture, blood money proportionate to the type of injury becomes obligatory, unless the right-holder pardons him.
