The fatwa in our view is that swearing by triple divorce results in the triple divorce taking effect upon breaking the oath, and the wife becomes irrevocably divorced (baynunah kubra). This is the opinion of the majority of scholars. As for the view of Sheikh al-Islam Ibn Taymiyyah, if the intention behind swearing by divorce is to threaten or emphasize, and not to suspend the divorce, then it is considered to have the ruling of an oath by Allah, and it requires an expiation for an oath (kaffarat yamin) and no divorce occurs.
