Is it permissible to take wild nightingale chicks to raise them in homes or to sell and benefit from them?

It is permissible to take birds that are not owned by anyone, as well as their chicks, and to raise them, sell them, and benefit from them. The basic principle is the permissibility of acquiring ownership of birds that are not owned by a specific person. The hadith (definition) prohibiting the separation between birds and their chicks is interpreted as a recommendation (nadb) and not an obligation (wujub). This is supported by the Prophet's -peace and blessings be upon him- approval of Abu Umayr's keeping of a bird.
