Is it permissible for the fiancé to speak with his fiancée over the phone or directly in the presence of a third party, even if it is a woman who is not a mahram?

The fiancée is considered a stranger to her suitor, and it is forbidden to be in seclusion with her. However, talking over the phone is not considered seclusion. Jurists differed regarding the permissibility of seclusion with her in the presence of a single woman; the well-known opinion is its permissibility if there is no fear of temptation (fitna). The Maliki, Shafi'i, and Hanbali schools of thought explicitly stated that seclusion is negated by the presence of a mahram (definition), a husband, or a trustworthy woman, as this prevents the occurrence of what is forbidden. Ordinary conversation is permissible if there is no fear of temptation and there is a legitimate religious interest.
