What is the ruling on one who passes the Miqat for Umrah without Ihram, and is a دم (sacrificial offering) required of him, and is one Hady (sacrificial animal) sufficient for repeating that action?
Scholars have differed on the obligation of entering into a state of for entering the (Mecca) for those who are not frequent visitors and do not have a specific need, holding two opinions. The preponderant view is that it is not obligatory, due to the absence of any proof for it, and because it is like the other Haram (Medina), for which ihram is not obligatory upon entry. The Prophet, peace and blessings be upon him, entered Mecca on the day of the conquest wearing his helmet. Therefore, whoever enters Mecca not intending to perform a ritual without ihram does not owe any expiatory sacrifice (dam). However, it is preferable for no one to enter without ihram, so as to avoid scholarly disagreement.
