Is it permissible to seek a Khul' (divorce initiated by the wife) due to the husband's failure to fulfill his marital duties, such as neglect in the marital relationship and household responsibilities, along with repeated, futile promises of change?

We advise giving the husband a second chance, as he might fulfill his promise and realize that his family has rights over him, and that what he is doing is not part of living together honorably. If he persists in his behavior, the wife has the right to seek divorce due to harm, and she is entitled to her rights of maintenance and deferred dowry. If he refuses to divorce, she may seek a khul' (dissolution of marriage at the wife's instance) from him based on what they agree upon, such as her returning the advance dowry and waiving the deferred dowry. Referring the matter to the Sharia (definition) courts is also a good option.
