Is it permissible for a young man to keep the built plot of land he bought from the profits of his trade, knowing that a portion of the capital for this trade came from selling stolen goods, but he has repented and returned the value of the stolen goods and disposed of the rest of the unlawfully acquired money, taking into account that this land is the location of his current trade?
If a person buys land and builds upon it with profits from stolen money, there are two scholarly opinions regarding the ruling on this land and what has been built upon it:
1. First Opinion: The profit follows the stolen principal. Therefore, the money and its profits must be returned to its owner. This is the view of Abu Hanifa and Ahmad. It is not permissible to give any of it in charity except with the permission of its owner, if he is present and can be reached.
2. Second Opinion: The profit is a consequence of the effort expended, not of the principal. Therefore, the profit resulting from investing ill-gotten money belongs to the one who took it, while the value of the stolen principal is returned to its owner. This is the view of the Malikis and Shafi'is, who cite the Hadith: "Profit follows liability."
