The question

What is the ruling on the occurrence of the second and third divorces, given that the first divorce occurred after the completion of menstruation and before intercourse, and the second divorce occurred after the completion of menstruation and the occurrence of intercourse, and the third divorce occurred after the completion of menstruation and the occurrence of intercourse, with the husband being angry? And is the wife permissible for her husband thereafter?

The answer

The ruling we adopt is the effectiveness of the divorce of a menstruating woman or a pure woman after intercourse – despite its being an innovation (bid'ah) – and the effectiveness of the divorce of an angry person, unless anger completely overwhelms his mind and deprives him of consciousness, such that he does not know what he is saying. Thus, the divorce of an angry person that occurs with awareness is effective. If the divorced woman completes three divorces, she becomes irrevocably divorced (baynunah kubra), and she is not lawful for her divorcing husband until she marries another husband willingly, and then he divorces her or dies, and her ' (waiting period) ends.
