Is it permissible to contract a legitimate marriage with a girl whose father refused her marriage to an expatriate, while her mother approved, and can the judge be her guardian?

If the suitor is suitable, the father does not have the right to prevent his daughter from marrying him without a valid Shar'i reason. If he does, he is considered an 'adil (one who unjustly withholds consent), and the guardianship transfers to the next in line. The girl has the right to bring the matter before a judge to marry her, or to order her guardian to do so.

It is advisable to try to convince the father and to involve influential people close to him. If he insists on refusal, the matter should be brought before a judge to marry her, if the 'adl (unjust withholding of consent) is proven.
