What is the ruling regarding a wife in the case of an unintentional miscarriage during the first four months of pregnancy?
If the miscarriage was unintentional, there is no sin upon the woman who experienced it, based on Allah's saying: "Our Lord, do not impose blame upon us if we have forgotten or erred," and the Prophet's (peace be upon him) saying: "My Ummah is forgiven for unintentional mistakes and forgetfulness."
As for blood money (diyah) and expiation (kaffarah), miscarriage has different cases: 1. After forty days: Without causing it: No diyah and no kaffarah. By causing it: Diyah is obligatory, and performing kaffarah is recommended. 2. Before forty days: Without causing it: No diyah, no kaffarah, and no sin. By causing it: Repentance is obligatory, but there is no diyah and no kaffarah.
The diyah for the fetus is the liberation of a male or female slave, or its equivalent, which is one-tenth of the mother's diyah.
