What is the ruling on divorce during menstruation or intercourse, if the spouses do not recall the time of menstruation or coitus, according to the legal school that does not validate divorce in these situations?

The majority of scholars hold that divorce occurs during menstruation or in a period of purity where intercourse has taken place. This is the fatwa (definition) we adopt, and we believe that adhering to it demonstrates piety and caution. Some scholars, however, hold that it does not occur. Nevertheless, according to the view that it does not occur, the divorce still takes effect if the husband did not recall menstruation or intercourse, based on the principle that certainty is not removed by doubt.
