Divorce pronounced over the phone is valid if the husband acknowledges it or if two just witnesses testify to it. The first divorce is valid. As for the second divorce, if the husband acknowledges that it was issued by him, then it is valid. He should be asked about his intention in repeating the divorce and the word of prohibition (tahreem) to determine whether it was one divorce or more. His suspension of the divorce is binding on him if the wife is lying, but it is not binding on him if she is truthful. The matter must be brought before the Sharia courts or presented to scholars for further clarification and determination of the Sharia ruling.
